Timothy Davis is a trial lawyer who has taken more than 65 cases to verdict. He is a former associate of McCutchen Doyle Brown & Enerson (now Bingham McCutchen) , a founder and partner of Clapp, Moroney, Bellagamba, [Davis] & Vucinich and the Chair of Hancock Rothert & Bunshoft's Labor and Employment Department, the recipient of Martindale-Hubbell's "AV" rating (highest possible awarded rating) and annually, including 2008 elected as a "Northern California Super Lawyer" (top 5%). Mr. Davis is a result-oriented litigator who devotes his practice to representing clients in a wide variety of civil litigation cases with an emphasis on employment disputes, business litigation, products liability and personal injury actions, professional negligence and errors and omissions cases. He is a consummate litigator whose court, jury and binding arbitration trial results have been consistently exemplary.
Representation including Trial Work in Product Liability, Premises Liability and Personal Injury Cases: Over the course of his many years in practice Mr. Davis has successfully handled literally hundreds of products liability, personal injury and general tort cases, many through trial, arising from vehicular, construction site, premises and other accidents of every kind, type and description. Representative clients include restaurant, hotel, retail, service provider, product distributors and automotive businesses, among others.
Representation including Trial Work in Employment and Labor Related Cases: Mr. Davis successfully has handled and/or tried to verdict virtually every type of employment-related claim in state and federal courts. By way of example in late 2005, after a hotly contested two week trial, he obtained a complete defense verdict in a difficult case dealing with a plaintiff's claims of rape and sexual harassment in the workplace. Over the course of the last twenty years, Mr. Davis has tried countless other employment cases alleging discrimination and harassment (on the basis of age, sex, race, disability, sexual orientation and other protected classifications), retaliation and whistleblower claims, wrongful termination, non-compete, non-solicitation, and trade secret and unfair business practices claims.
Representation including Trial Work in Professional Negligence, E & O and Business Dispute Cases: Spanning a long career as a trial lawyer, Mr. Davis successfully has tried to verdict and handled a broad spectrum of complex, high-stakes cases involving consumer fraud claims, breach of contract, unfair competition, false advertising, defamation, and professional liability and E & O claims, successfully representing auto dealerships, contractors, retail establishments, technology companies, food service companies, lawyers and law firms, architects and engineers, insurance and real estate brokers and agents, health care professionals and accountants. Again by way of example a client retained Mr. Davis as trial counsel on the eve of trial, after all discovery had been completed, obtained a complete defense verdict in a nearly six-month jury and court trial addressing allegations of unfair competition under Business & Professions Code §17200, corporate alter ego, false advertising, fraud, and defamation. Clients regularly retain Mr. Davis based on referrals from insurers and professional peers which affirms Mr. Davis' well-earned reputation as an extremely effective, result driven, fearless trial advocate.
Business and Employment Counseling: Mr. Davis also has long represented and obtained winning results for clients at trial and in other forums, including administrative proceedings before the Department of Fair Employment & Housing, Equal Employment Opportunity Commission and San Francisco Human Rights Commission. His practice also includes advising clients regarding business disputes, litigation avoidance, and all aspects of the employer/employee relationship, ranging from decisions on hiring, employee classification, and wage and hour issues, to issues of employee privacy, discipline, and termination. Mr. Davis and the attorneys at The Davis Law Firm also have great expertise in establishing work place policies, procedures, practices, and preparing employee handbooks, and conducting training for managers, supervisors and employees in programs specially tailored to the needs of particular clients.
Mr. Davis obtained his B.A., With Distinction, from the University of Virginia. He earned his J.D. from the University of Virginia Law School. Mr. Davis served as a First Lieutenant in the United States Army from 1968 to 1971, including a year in Vietnam as a Company Commander. He is active in a host of civic and professional organizations and associations.
